Our webcast “Transfer pricing certainty, in uncertain times” focuses on:

 

  1. APA: during the seminar we will discuss our experience concluding APAs with the Dutch Tax Authorities (DTA) under the ruling practice as of July 1, 2019. We will explain what topics are eligible to conclude an APA and whether the application of the median is still the golden standard used by the DTA. We briefly touch upon the topic of multi- and bilateral APAs.
  2. Tax audits: our team will provide some highlights on the main themes checked by the DTA under audit.  
  3. MAP: finally we will provide in-depth insights into our MAP experience with the UK, Germany and Italy.

Ágata is partner with the transfer pricing team of Meijburg & Co and member of KPMG’s Global Transfer Pricing Services. She has 20 years of experience working full-time in the transfer pricing field.  She has experience negotiating advance pricing agreements (“APAs”) and defending complex transfer pricing audits. Most recently, she has acted as expert witness supporting tax litigation in several European countries. Ágata is frequent speaker at international tax events (IBFD, BNA training courses, OECD consultations) and is invited as guest lecturer at the University of Leiden (Adv. LLM International Tax Law), University of Amsterdam and University of Vienna. Ágata won the award for Best in Transfer Pricing at the European Women in Business Awards in 2011, 2013, and 2016 and is regularly mentioned by Euromoney as one of the best transfer pricing advisors in the world. She takes an active role promoting diversity in the workplace and mentoring and coaching people. Eduard is a Director at KPMG Meijburg & Co and a member of the Dutch and KPMG Global Transfer Pricing Services practices. He has assisted a variety of multinational clients in designing and implementing their global, European, and Dutch VCM/transfer pricing initiatives, and has successfully defended a wide range of transfer pricing cases in tax audits and obtained Dutch tax rulings and unilateral Advance Pricing Agreements (APAs). Drawing on his 35 years of VCM/transfer pricing experience, Eduard places a particular focus on the application of the EU Arbitration Convention and Mutual Agreement Procedures to help clients headquartered in the US, Europe and Asia achieve successful dispute outcomes. He has vast bilateral and multilateral APA experience. Early in his career, Eduard worked with a number of multinational companies, including US-based ones, where he was responsible for developing solutions to complex VCM/transfer pricing issues. Eduard has led a series of major international VCM/transfer pricing projects, including both multinational and bilateral APAs. Eduard is a frequent contributor to tax journals and publications including BNA’s Transfer Pricing Journal, the Tax Management Transfer Pricing Report and the International Tax Review. By virtue of his work, he has been named as one of the leading Dutch transfer pricing specialists in the Guide to the World’s Leading Transfer Pricing Advisors every year since 1999. Eduard holds a degree in Tax Law and International Tax from Leiden University and is a member of both the Dutch Association of Tax Advisors and the International Fiscal Association.

Disputes with tax authorities often stem from transfer pricing. Janneke has specialist expertise and extensive experience in transfer pricing. As a member of the Tax Controversy team, she is perfectly placed to not only advise clients on the procedural aspects of tax controversy and dispute resolution, but also to offer subject matter expertise and provide advisory input on clients’ transfer pricing policies. Janneke can also help to prevent disputes by assisting clients in creating robust transfer pricing documentation and securing ATRs for their transfer pricing practices.

Jens has over 29 years of experience in the field of taxation. He currently works in Meijburg & Co’s international corporate income tax and transfer pricing practices. Jens began his career at the Dutch Tax and Customs Administration, where he held a variety of positions. He was a member of the Dutch Revenue's APA/ATR team in Rotterdam, where he specialized in international structures and related transfer pricing issues. He left the Dutch Tax and Customs Administration to join Meijburg & Co in 2005. Jens focuses on tax and transfer pricing disputes in a national and international context, making use of available dispute resolution instruments such as APA’s, ATR’s, mutual agreement procedures (MAPs), bilateral investment treaties (BITs),  joint audits and of his extensive network. Jens has a Law Degree from Tilburg University and is a member of the Dutch Association of Tax Advisors.
